Veterans in New South Wales often ask whether their state changes their claim. The honest answer is the same one we give in every state: your main claims are federal and work the same everywhere, but a few things genuinely change at the border. Here is what stays the same, and what is actually different in New South Wales.
What does not change: your DVA, CSC and TPD claims
Your core claims are federal. They are governed by national law and administered the same way whether you live in Sydney, Newcastle, Wollongong or Wagga:
- DVA compensation runs under Commonwealth legislation, and from 1 July 2026 new claims are handled under a single improved MRCA following the VETS Act reforms. Your postcode does not change your entitlement.
- Commonwealth Super (CSC) invalidity claims across DFRDB, MSBS and ADF Cover are a national scheme with identical rules in every state.
- TPD claims depend on your superannuation fund and policy, not your state. The fund’s definition of disability is what matters, not where you live.
So if someone tells you a claim is “better” in one state than another, be sceptical. For DVA, CSC and TPD, that is not how it works.
What does change in New South Wales
Three areas are genuinely state-based, and New South Wales has its own rules for each.
1. First responder workers’ compensation
If you moved from the ADF into emergency services, your first responder injuries are covered by the NSW workers’ compensation scheme, not DVA. New South Wales treats police, paramedics and firefighters as exempt workers under the Workers Compensation Act 1987, which means they keep more generous entitlements than most other workers. Importantly, the stricter psychological-injury rules that started on 1 July 2026 largely do not apply to first responders in the same way. This is a meaningfully different structure from Queensland’s presumptive pathway, so advice needs to be state-correct. We explain it in our guide to NSW first responder compensation.
2. Gold Card concessions
Your Gold Card is a federal entitlement, but the concessions attached to it are set by each state. New South Wales runs two separate transport schemes that get confused, the Gold Opal Card (a daily cap) and a separate free-travel concession card for eligible veterans, and the vehicle and registration exemptions require a TPI, EDA or War Widow marking or a qualifying DVA letter. We cover the detail in our guide to NSW Gold Card concessions.
3. Abuse claim limitation law
Claims for historical abuse are governed by state limitation law. New South Wales has removed the time limits that once blocked historical child abuse claims, which means claims can proceed even where the abuse occurred many years ago. The position differs between states, so where the abuse occurred and which state’s law applies both matter.
Why this matters when you choose who to work with
Because the core claims are federal, you do not need a lawyer physically in your suburb, you need one who runs these claims well and knows the NSW-specific pieces that do apply. KSC Law acts for veterans and first responders right across New South Wales, from the Sydney, Newcastle and Nowra defence communities to the Riverina, online and by phone. If you want the local picture, start with our New South Wales veterans’ claims hub.
