TPD claims in the ACT

TPD Claims

Could you have a TPD claim?

Total and Permanent Disability cover is held inside most super funds. Answer a few quick questions to see if you may be able to claim. This is a guide only, not a determination.

This is a general guide only, not an assessment of your policy or eligibility. TPD outcomes depend on your individual super fund or insurance policy terms. This does not constitute legal, financial or medical advice. Book a free consultation for a personalised assessment.

Identify the type of benefit

Check your superannuation, scheme and insurance documents before assuming which entitlement applies.

This is particularly important for current and former ADF members. CSC administers separate military invalidity arrangements through schemes including MilitarySuper, DFRDB and ADF Cover. Those invalidity benefits should not be treated as the same thing as a private TPD insurance claim.

Where private TPD insurance applies, the policy sets the disability definition and other requirements. Depending on the cover, this may involve your own occupation, work suited to your education, training or experience, or specified activities of daily living.

Evidence about suitable work

For a policy using an “any occupation” definition, the assessment concerns whether you are unable ever to work again in a job suited to your education, training or experience. Being unable to return to your previous position does not necessarily establish that requirement.

Medical evidence should address the relevant condition and its effect on your ability to work. Your employment history, qualifications and training can also be relevant to the policy assessment.

Keep any medical retirement, CSC or workers compensation decisions with your records, but consider them separately from the TPD insurance requirements.

For ACT workers compensation, the applicable system can also depend on the employment arrangement. WorkSafe ACT regulates the ACT private-sector workers compensation scheme, while ACT Public Service claims operate under the Safety, Rehabilitation and Compensation Act 1988.

Understand payment steps

If your TPD cover is held through superannuation, check the rules applying to access to the benefit and any tax consequences.

Keep records for each insurance, superannuation or compensation matter separately so it is clear which decision and payment relates to which entitlement.

Talk through your circumstances

If you are researching TPD claims in Canberra, bring your current and previous super statements, insurance information and any existing decision letters to KSC Law.

KSC Law can help identify which arrangement needs investigation, explain the applicable requirements and discuss the proposed work and costs before you decide whether to proceed.
