Veterans in Victoria often ask whether their state changes their claim. The honest answer is the same one we give in every state: your main claims are federal and work the same everywhere, but a few things genuinely change at the border. Here is what stays the same, and what is actually different in Victoria.
What does not change: your DVA, CSC and TPD claims
Your core claims are federal. They are governed by national law and administered the same way whether you live in Melbourne, Geelong, Ballarat or the Latrobe Valley:
- DVA compensation runs under Commonwealth legislation, and from 1 July 2026 new claims are handled under a single improved MRCA following the VETS Act reforms. Your postcode does not change your entitlement.
- Commonwealth Super (CSC) invalidity claims across DFRDB, MSBS and ADF Cover are a national scheme with identical rules in every state.
- TPD claims depend on your superannuation fund and policy, not your state. The fund’s definition of disability is what matters, not where you live.
So if someone tells you a claim is “better” in one state than another, be sceptical. For DVA, CSC and TPD, that is not how it works.
What does change in Victoria
Three areas are genuinely state-based, and Victoria has its own rules for each.
1. First responder workers’ compensation
If you moved from the ADF into emergency services, your first responder injuries are covered by the Victorian WorkCover scheme run by WorkSafe, not DVA. Victoria offers provisional payments, up to 13 weeks of mental health treatment support while a claim is assessed, even if it is later rejected, and while the state tightened mental injury tests in March 2024, there is a carve-out for injuries predominantly caused by traumatic events that most often applies to frontline workers. This is a different structure again from Queensland’s presumptive pathway and New South Wales’ exempt-worker model, so advice needs to be state-correct. We explain it in our guide to Victorian first responder compensation.
2. Gold Card concessions
Your Gold Card is a federal entitlement, but the concessions attached to it are set by each state. Victoria offers genuinely tiered vehicle concessions, around 50% off registration and TAC for a standard Gold Card, and 100% off registration for a TPI card, plus a free-travel myki for TPI and EDA holders and a motor vehicle duty exemption for eligible veterans. We cover the detail in our guide to Victorian Gold Card concessions.
3. Abuse claim limitation law
Claims for historical abuse are governed by state limitation law. Victoria has removed the time limits that once blocked historical child abuse claims, which means claims can proceed even where the abuse occurred many years ago. The position differs between states, so where the abuse occurred and which state’s law applies both matter.
Why this matters when you choose who to work with
Because the core claims are federal, you do not need a lawyer physically in your suburb, you need one who runs these claims well and knows the Victorian-specific pieces that do apply. KSC Law acts for veterans and first responders right across Victoria, from the Watsonia, Puckapunyal and HMAS Cerberus defence communities to the regions, online and by phone. If you want the local picture, start with our Victoria veterans’ claims hub.
